What to Expect After a DUI Arrest

After a DUI arrest, two separate legal processes begin—Administrative (DOL) and Criminal (Court). These are independent of each other and proceed on separate timelines.

It typically starts when the prosecutor files formal charges, which may be days or weeks after the arrest. Your first court appearance is called an arraignment, where you enter a plea. The court process can involve multiple stages.

This case is handled by the Department of Licensing (DOL) and focuses solely on your driving privileges. It begins immediately after your DUI arrest, usually when you're issued a Notice of Suspension. You have a very limited window (typically 7 days) to request a hearing to contest the suspension.
